The fifth session of the Permanent Military Court (PMC) examining the charges against the members of the disbanded South Lebanon Army (SLA) convened on Monday June 19 and was marked by two distinctive features; the output on this day's work, some 100 sentances, outmatched anyone of the previous sessions. On the other hand a slight departure was noted in the mechanical rendering of sentences. A case in point will be that
of the defendant Ali Ahmad Abdallah, who admitted not only his membership of the SLA but equally his role in providing intelligence to the Israelis. The PMC found him guilty and sentenced him to two years. Five years were meted to Naser Ali Khaz'al, who admitted informing on the inhabitants of his village and Hizbullah. He elaborated at length on his regular meetings with the Israeli intelligence officer who paid him in cash 100 US $ for each encounter, Khaz'al shall be in jail for the coming 5 years.
It is observed, however, that the 2 year in jail of Abdallah is exactly double the sentance received by Fadi Na'im Faraj, who claimed that his poverty compelled him to join the SLA where he served as a guard. Furthermore, Faraj shall be released from jail simultanously with Mahmoud Abdel Aziz Aqil who admitted taking part in active combat on the side oif the Israelis against Hizbullah.
Of course there is no way for us to verify the truth in the allegations of Faraj. But the court is hardly in a better position. No examination of the charges by the court or pleadings by the lawyers took place. Even the court's ruling, unlike those of normal courts and in conformity with the Military Court Law of Procedures, mentions in short hand the sentence without any justification of it based on facts and law.
The rest of the fifth session will be very much deja vu and more of the same; the usual passing of files to the Legal aid committee is still on the eve of the session. Defendants are sorted out in accordance with the charges and are collectively tried. No witnesses or cross examinations take place while the bulk of the cases pass to be sentenced with no proper defense but a simple plea for clemency and mercy by the lawyers rehearsed by the defendants and automatically repeated by them when the court asks how do they plead. Even in cases when lawyers decide to hazard a defense, it will be invariably in the
form of a litany blaming the crime of collaboration with the enemy on the merciless economic needs and the boundless intimidation of the Israelis and pressure by them on the defendants to collaborate. No personal evidences concerning the defendant were presented by the different lawyers. The FHHRL's observer found that each defendant would be processed, on average, in 90 seconds, and in the rare cases when there is a defense, the defendant will command some attention for up to 5 minutes. The rest, has Hamlet ends, is silence.
